Terms of service

These terms are an agreement between Denover MMC Private Ltd, Bengaluru, India ("we", "us") and the company that registers for Phygitaim ("you"). By registering or using Phygitaim you agree to them on behalf of your company.

1. The service

Phygitaim helps you plan and run marketing campaigns: AI drafts strategy and content, your team and approvers review it, and Phygitaim publishes it to the channels you connect, sends emails and runs calls and events. Features depend on your plan.

2. Your account

• Keep sign-in details safe and use two-factor sign-in. You are responsible for what happens under your company's account.
• Administrators decide who joins the company and what role each person has.
• Give us accurate company, billing and contact details and keep them up to date.

3. Plans and payment

• Plans are paid in advance for the plan period. Prices and what each plan includes are shown when you choose a plan.
• Taxes are added where the law requires (for example GST in India).
• There is no grace period. When a plan ends and isn't renewed, your data is removed from Phygitaim and kept as a backup for 90 days so it can be restored; then it is deleted. We remind Administrators before the end.
• Payments already made are not refundable unless the law requires otherwise.

4. Your content and data

• You own your content and your contacts. You give us permission to store, process and publish them only to provide Phygitaim to you.
• You confirm you have the right to use the content you upload and to contact the people in your data sets, including any consent the law requires for emails, text messages and calls.

5. Connected accounts

When you connect a LinkedIn, Facebook, Instagram or YouTube account, you allow Phygitaim to publish the content you approve to it and to read the results. You must follow each platform's own terms. You can disconnect at any time.

6. Acceptable use

Don't use Phygitaim to send spam, mislead people, break the law, infringe others' rights, upload harmful code, or try to break into or overload the service. We may pause or close accounts that do.

7. AI-generated content

AI drafts can be wrong or incomplete. You and your approvers are responsible for checking content before it is published.

8. Availability and changes

We work to keep Phygitaim available but don't promise it will never be interrupted. We may change or improve features; if a change reduces what your plan includes, we will tell you in advance.

9. Liability

To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid for Phygitaim in the 12 months before the claim.

10. Ending the agreement

You can stop using Phygitaim at any time. We may end the agreement if you break these terms. Sections 3 (data removal and backup), 4, 7 and 9 continue after it ends.

11. Law

These terms are governed by the laws of India, and the courts of Bengaluru have jurisdiction.
